Land Liability Insurance

Owning land, a private road, or a building plot, brings with it responsibilities. Private landowners are exposed to a range of potential risks and consequently, claims. Landowners have a duty of care to take reasonable steps to protect members of the public from potential dangers on their land.

Land liability insurance, also known as Vacant Land Insurance, is a type of insurance policy designed to protect landowners from financial losses due to accidents or injuries that occur on their undeveloped or vacant property. This insurance provides coverage for legal fees, medical expenses, and damages if someone gets hurt or if there’s property damage on the land.

Whilst Land Insurance is not a legal requirement, if a third party does injure themselves or damages their property whilst crossing your field, using your car park, or being on the land that you own, they could attempt to take legal action against you. You could be held liable for their medical expenses and other related costs. This insurance helps cover legal defence costs and any settlements or judgments against you.

Land Insurance is a type of Public Liability Insurance that covers any legal fees and compensation pay-outs if a claim is upheld. Claims for injuries such as a trip or a fall, or damage to third-party property, such as that caused by a falling tree branch, often result in high costs, so this cover is invaluable in mitigating the financial consequences of such situations. In addition, if an incident on your land causes damage to someone else’s property, Land Liability Insurance can cover the repair or replacement costs. Land Insurance can also protect you financially from damage that could happen on your land accidentally, or by straying animals, for example. This can also include broken fences or gates.

If you own fields, (with or without public rights of way), woodland, land with water such as ponds or rivers, derelict buildings, private roads, or car parks, you should consider having land insurance for peace of mind. If people use your land for recreational activities like hiking, hunting, or off-roading, the risk of injury increases.

If you are planning to sell your land or property, then potential buyers may feel more secure knowing the land is insured against liabilities, potentially making the property more attractive and easier to sell.

Exclusions to Be Aware Of

There are certain circumstances where Land Liability Insurance cover does not apply- such as environmental hazards, as typically, land liability insurance does not cover pollution or environmental damage. It also won’t cover damage or injury caused by intentional actions by the landowner or authorised persons and if the land is used for commercial purposes , you may need a more specific policy.
